While these surgeries usually go well, whether done laparoscopically (instruments inserted through small holes) or open (large incision), injuries may occur when the wrong ducts are cut another organ is lacerated. Determining if injuries like these are the result of unavoidable complications versus carelessness is the job of your attorney relying upon a consulting physician experienced with these surgical procedures.
Surgical injuries can arise in many other circumstances, including by example: nerve damage when performing carpal tunnel (wrist) surgery or the severing of a nerve during thyroid surgery; failing to time surgery in consideration of injury related directly to the negligent delay, (such as internal bleeding or risk of bleeding) allowing a condition such as an aneurysm to rupture; and, technical errors such as the failure to properly set a fracture.
